ROBO-SIGNERS "MICHELLE HALYARD" and "KATHY SMITH"

Trust me when I tell you: I truly believed that American Home Mortgage Servicing Inc was trying to help me with my Loan Modification. Browsing through their Website, one gets the impression that this Company is a good Company... Right?

After the Adjustment rate that sky-rocketed my Monthly Payment to over 5,000... Well, I thought their intentions were truly genuine. Only after being served with foreclosure papers I finally realized that after more than 12 months sending the SAME DOCUMENTS OVER AND OVER it was all a game... Just a game on their part to "make good" on promises to the Federal Government that they were really trying to save Homeowners from foreclosure.

Only after browsing in the Internet and News I came to realize what kind of Company this one really is.

Same people here have the Robo-Signers. That's bad enough. Same have American Home Mortgage Servicing, that's bad enough. Same have Shapiro & Fishman, that's bad enough...

Me, well... I have ALL THREE.

I purchased my home in 2006 @ a cost of 610,000 with a Down Payment of 162,500. That's no joke folks...

This was the home of my dream... My place of retirement. My case is NOT like those that purchased with no money down... Not with 5%.. Not 10%... Not BS... Over 33% DOWN PAYMENT. Do you want a more Serious and Responsible Buyer...?

After a lifetime of work, I sold everything I had in NY and decided (Why did I ever do this..!!!!) to come to sunny Florida. I purchased my home and some investment property... Only to see the Banks giving loans to everyone with NO DOWN PAYMENT... People that will default 6 months later wrecking the Real Estate Market to the point that my Home Value is now about 260,000... Can I sell? Should I walk away broke? Should I go back to NY and start over at 55...?

On top of all of the above, we have Crooked Mortgage Co's, Foreclosure Mills and Robo-Signers... Huh?

I did some research on Michelle Halyard. She seems to be a Co-Defendant in some Class Law-Suit in KY. Kathy Smith is widely know to have signed as everything, from Vice-President of some Companies to Record Keeper... And Shapiro & Fishman... Well, should I go on...?

Thanks God for Florida State Attorney Bill McCollum. God bless his efforts.

Off course, I know she is just an employee of Lender Processing Services in Jacksonville, FL, and by no means any "Vice-President" or "Any Title Whatsoever" but I am just trying to dig a little deeper into this mess... Does anyone have any info in the Criminal Record below..?

I read this after reading your most recent post. Being an in real estate myself and knowing 1st hand the corruption they envelope themselves in I'd say you've been had. The courts don't have any decency towards people regardless of the amount they have to put down on a home. Or what your true intentions are to rectifying your situation.

 

The only thing they may understand is a bar complaint if the Florida Dept of Justice isn't on the take like MO. Best of Luck in fighting the Corruption!

Yep, Not only that, but the main reason for this blog: Michelle Halyard and Kathy Smith are well known infamous ROBO-SIGNERS. Both have been shown to sign as anything from "Vice-President" to "Records Custodians" of any well know Financial Institution, from CountryWide to Citigroup to Chase... Go figure...

I originally did not look at the AOM. If I am looking at it correctly they are stating that these 2 bafoons assigned the mortgage from Countrywide in March of 2010. I would think that would be a little difficult considering CW filed bk in april of 2007.......

Well no... My original Home Mortgage was CountryWide Home Loans. In fact, the above picture is the so called "assignment" affidavit. Which is basically fraud. (just read the top of the above pic)
I know, AHMSI have no right to foreclosure, nevertheless, the have the right to accept/approve any and all agreements as stipulated even in the Complaint Summons as the "Loan Servicer" (In my case) but that is not my problem anyway.

My mortgage was "assigned" to "Citigroup Global Markets Realty" and they started the foreclosure based on the above-shown fraudalent "affidavit".

The so called "Mod" does not really exist... I want everybody here to be aware of this. If I don't qualify for a Modification, I don't know who will: I am a Real Estate Investor with ownership of multiple rental properties. I am also a business owner, with verifiable income and equity in my business. Not just "any BS business", two 10,000 s.f. Automotive Repair Shops, fully Licensed and operational... So, don't waste your time sending in any of this BS "Mod" packages to these guys.

Thanks for your input anyway... Don't worry; They just happened to pick the WRONG guy in this BS: Never mind Poker... I don't even know how to play it..!!!
In the other hand, I am a extremely proficient Chess player, to the point that even in HS I used to play with 5-10 players at once. I also hold a couple of Degrees... My strategy is simple-straight-forward-battle-mind-oriented: TOTAL WAR.

Frank welcome to the world of AHMSI3 owned by billionaire Wilbur Ross. I will save my rant on how you never received a loan in the first place and reply to your situation with my opinion (which is just that - my opinion). I am in FL and also have AHMSI3, and assume that your original mtge was w/ American Home Mortgage or American Home Mortgage Acceptance (unless your org lender was one they took servicing over for).

First let's begin with AHMSI3 does not have, never will have the rights to foreclose on anyone! Nor do they have the rights to offer or provide anything in the way of a modification. Actually they have no authority to do anything related to your loan other than collect your monthly payment. They are a strictly a servicer or rather debt collector (all their materials, and telephone calls state such) for whomever your supposed note holder is.

AHMSI pretty much took over for two lenders who went belly up which is American Home Mortgage and also at a later date they took over for another banrupt entity Option One. In my case American Home Mortgage went BK in early 2007. They were a key player in writing sub-prime and Alt-A loans the first wave of sub-prime meltdown wiped them out.

Their loans include MERS as most do, and most if not all of their loans were also like packaged into MBS. Considering how that fiasco is currently playing out who knows about your loan properly making into a PSA before cut-off, or if they duped investors by saying your loan was of a particular type.

let me take a stab in the dark here, besides the constant bs about having to resend paperwork for a mod (which is a scam in and of itself) or resending due to lost paperwork, every time you called (except maybe once) the call went to a call center in india and the agents give you the run-around. Sound familiar????


Ok speed up to the present. I only awoke to the biggest ponzi scheme in history about 3 months ago (wish I noticed sooner). Anyhow, I called AHMSI3 to ask who the "actual" holder of my note was, or whom currently maintained a valid copy of the actual "wet ink" note and produce that note if requested. A nice little old lady mistakenly told me who it was over the phone. So I searched both sec and edgar to find out that while she told me the info, she did not include the "full name" (ex AHIT 2004-C) she didn't give me the 2004-C part. So I called back, and shockingly for only the 2nd time in 3 years spoke with an american operator and told him that I had called in recently to find out who the note holder is. His response "we can't tell you that" you can send in a QWR if you wish (also funny, all the sudden about 3 mos ago AHSMI3 started to include on the back of your mortgage payment statement the address to send a QWR) for years prior to that - that info did not exist on their statements.

Anyways, I proceeded to tell the agent that I had previously spoken with another agent and got the name of note holder, but not the full name. I could see the snide look on his face over the phone as he said no you didn't. So I said well yes I did, and here is the name of the trust. He stated verbatim "wow you got that info, protocol is to tell you we can not give that inf out over the phone"....just imagine alarms must have now been going off in the call center and flashing lights. At that point he said, well heck since you already have that, here is the full name. I thanked him and hung-up.

I sent AHMSI3 a QWR asking for the standard, name of note holder, full accounting history sine they took over servicing my loan, name and address of holder for process service, etc.

3 weeks later I received their bs reply which stated:

If you have any concerns about unethical business practices or predatory situations regarding your loan, this is an official document informing you that we are not affiliated with your original lender or broker. Those issues should be directed to the original lender whose last known address is ________. (Gee a******, thanks for the info but they went bankrupt 3 years ago.)

Also we do not provide a copy of the note unless you sell your home or the loan is paid in full. Really? I wasn't asking for the original, just a copy. The additional information you are requesting is used for internal purposes only and we cannot furnish that information and are not required to do so.

Hmmm....I want to see a copy of your contract to make sure it matches my contract, and I want the accounting of the monies I've paid in on that contract, and that is for internal purposes only? I wasn't asking for the secret recipe of Colonel Sanders extra crispy chicken....

And lastly, which this was the best part....the trust that is the supposed holder of my note exists in NY, however in their reply they did indicated the address and phone number of the trust for any written communication -- and guess what, the address and phone number of the trust is the same address and phone number for AHMSI3???

So assuming you understand the fraud and the foreclosure fraud, nickels to dollars they don't have squat to enforce your obligation, nor do they have the rights to foreclose on real property as a result. Sure they have a nominee MERS which we know how that's been going lately....Sure they have a trustee....and sure there is a supposed investment trust that holds the note.

But did all of this happen in accordance to the law? Was proper chain of title and assignment followed? Did my loan make it to the trust in accordance to the PSA? Was my loan packaged and sold off in more than one trust when it shouldn't have been? IMHO, I doubt it.

While we are talking about peoples lives, homes, etc. think of it as this. This is poker, and the guy who keeps on winning even though he's nothing but a good bluffer, will continue to do so until someone with a good hand calls him out and beats him, or tips off that he is merely bluffing.

At 55 how do you really start over? I say you beat them at their own game and call their bluff. They're sitting with a pair of 7's while you have a royal straight flush.

This is chess, not checkers Frank....what will your strategy be to win?
