I do not delete any. EVERY e-mail passing through the system is archived. You asked for every e-mail I sent or received in December 2009, that means them all, that means we need to pull some of them out.

I am sorry, but e-mails on illnesses and deaths and family issues of employees are NOT public record and NOT coming your way. Nor are ongoing investigations or juvenile cases. If you think they are, get your attorney.Do you somehow think these e-mails do not pass by me? Do you understand what my job is? I am not a County Commissioner or School Board member who comes to meetings while the County Manager
and School Superintendant handles the daily business, all of the daily business passes through me.
My HR guys are not going to attest to squat. We will redact as best we can. They will be reviewing thousands of e-mails, obviously some more closely than others, and mistakes may be made.
Nothing is deleted from the archive. There is no need to do so. There are tens of thousands of e-mails passing through our system every week, nobody has the time to sort all that out and selectively delete anything. CommVault was selected back in 2006 to give us a much better
archive system than storing a zillion .pst files as we had before.
Our job is to provide you public records. Our job is not to jump through as many hoops and questions as you may devise. We will get you the e-mails and those not public will be removed as best we
can.
You have the press on here, as well as the County Attorney, if you think you should get more you have your audience.

You are not going to divulge what sir? I'm only asking for YOUR emails
(from DEC 2009 only) and the dates & times of YOUR deleted emails
(from DEC 2009 only). Voyeurism... are you high? This is public record
we are talking about. I don't need all of your other staff members
emails Scott. I'm only wanting yours. Yes, I would like to make sure
nothing "impartial" happens during your "editing" process. Besides, we
may have a need for future depositions, this is nothing to worry about,
is it? You will basically have them attest to the fact that they only
pulled out items that met _______ criteria and nothing else. Perhaps the
other individuals who will be listed as having full admin rights should
attest they didn't already delete anything. This is possible you know?
It is fair, it is public record & it is your job to
accommodate/facilitate my request. Thank you for your help and
cooperation, I greatly appreciate it!

We are not going to divulge it, period, when it comes to confidential issues. There is a line between public
records and electronic voyeurism. No, we also cannot sort out in reverse by keyword. When you ask for EVERYTHING that is what gets pulled in. Everything brings in all of the Human Resources e-mails, what else would you expect?
If we pulled anything else we would be in violation of the law. There is no need for further attestation. They
will do the best job they can, nobody is perfect. You absolutely have no comprehension of the thousands of e-mails passing through my account every week.
Do you think I am at work almost every night answering e-mail because I sleep all day?

That is why I asked for a summary of the total # of your emails, total # of your emails removed from the request, & a list of the dates & times that any and all emails were deleted - this way I can see what is missing without your office having to divulge specific confidential information. I need to have the full scope. Not trying to
be a pest sir.
In order to expedite the process is it possible
to have Carlene and Renee enter keywords (such as
illness, deaths, disability, juvenile courts) so they can track (and remove) the emails that will not be sent with the balance of my request?
Let's go ahead and start with
December of 2009's emails only for now.
I will ask that anyone
involved in the process of pulling, batching, reviewing, removing, or other function relative to the request attest to the fact that only information of a true & confidential nature (such as illness, death, disability & juvenile court) were removed from the request.
Thank you!

You need to get realistic with your
request, please. The e-mail archive is all e-mails passing through the
system.
What do you mean by e-mails deleted? You get all of the e-mails. They don’t ‘delete’ from the archive. Do you
understand how an archive system works?
To pull all of the e-mails from December of 2009 forward will start with a $100 deposit. From there the time to
go through them will be added. Human Resources will go through the e-mails, Carlene Price and Renee McGrory. The check should be payable to Brevard County and mailed to the Clerk’s Office attention Vicki Robinson.
Richard Jones, Brian Meyer, and Mike Bowen will handle pulling the e-mails from the archive.
Mike and Cindy will send you who has administrative privileges for FACTS and CommVault.
ArKay has the CommVault contract for Brevard County. We handle a lot of our CommVault issues with the vendor ourselves. Mike Bowen can let you know
how
much work ArKay has done on CommVault for us.

6) Who will be screening your emails
from your account?
7) How many total emails did you have in Dec
2009?
8) How many deleted emails did you have in Dec 2009?

Did Arkay compete for what bid?

Did Arkay compete for their bid? Does FACTS track the dates and times changes were made to docket entries? Am I able to tell the dates and times changes were made to info (name, date address) on the FACTS system?

Actually sir, I am seeking the proper creditor & I couldn't care less about this place! Can't wait to get to court & show how many issues of material fact that are coming through your office by the thousands. Not to mention the issues of undisclosed parties slid in on the docket. Then there are the problems with the (obviously) fake note exhibits. I don't think there is anything CORRECT at all in my case. GO FIGURE!

You have your opinion of the law, everyone else has theirs. You claim they are fraudulent, the courts do not believe so. You have the press here on the e-mail, fo to them and explain to them your fraud of the century. You claim the loan is a fraud, yet you used to acquire the property, and now while you seek to dun the creditors over the allegedly bogus loan, you want to keep the real property.
If you think you'll come in to the Data Department and direct the search yourself you will need to bring a check. We have plenty of work to do and we have to spend hours explaining how the search works in CommVault you are going to have to pay for the time.
A public records request is one thing, but I honestly have no idea what you desire.
Richard and Brian, when can Mr. Public come over to Data to initiate the search? Please log your hours while you are going through this.
Mr. Public, please bring your down payment check of $100. We will totla up the bill for Data and Human Resources at $20 an hour. We normally do not charge much on these but we have never had someone who wants to sit in the seat and Data and watch. Hopefuly you are familiar with the archive software.
Thanks, Scott

Subject: RE: Request for Public Information (fraudulent recordings in public land records)_but will he do anything about it?
That's exactly the problem, trying to discover who the REAL lien holder (the REAL CREDITOR) is. You assume I cannot or am not making payments which is an incorrect assumption. So tell me then why these large financial institutions need to record fake assignment of mortgages (see attached) and intentionally withhold vital information about the back side of the transaction where they convert "negotiable instruments" into securities "weapons of mass destruction" thereby using borrowers credit score, signature and collateral to defraud third-party investors.
*Note improper recording standards on the RECORDED AOM - No address of original lender, No corporate seal, No consideration listed in the "alleged" conveyance ALSO ASSIGNOR & ASSIGNEE ARE ONE AND THE SAME. You simply cannot assign something to yourself. It would be like me recording a discharge of mortgage on the property, except I'd go to jail for that.
Had someone mentioned these "shenanigans" at time of loan application, I'm sure MILLIONS of us would never have signed up for it. This would have made me run run as fast as I could. It has destroyed the US economy & lives of MILLIONS of American citizens and now the only way the fraudsters can perfect the deal (so they think) is by filing false AOM's en masse & foreclosing at break-neck speed. Jamming them through the system as fast as they can before we, the American people, catch on.
Nobody ever tells you anything about MERS, like who they are and why they need to be involved in the transaction. Hint, it is an easy way to hide off book transactions. This is in addition to the fact the they (MERS) "supplant" themselves on HUD-1 statements for a mere $3.95 registration fee which is not discussed at any time in any good faith estimate or prior to closing.
Perhaps it is because there is no default insurance for mortgage mods or short sales... you think? Nonetheless that is another story for another day. Anyone who would like to read more about our prior email exchanges can view them here;
http://tawebster.spaces.live.com or here;
http://www.foreclosurehamlet.org/profile/twebster321I will be happy to provide keywords for searching on the day of our appointment.

I asked you quite some time ago about checking in to these fake AOM's being put on record.
(see
http://4closurefraud.org/)
I also submitted to you a copy of my recorded assignment of Mortgage that lists the assignor & assignee as being one and the same. In addition I showed you that Christina Trowbridge (who authorized that AOM) is an employee of JP Chase and asked you how CHASE can assign assets to themselves in public records. Again I ask, are you willing to audit the public records of this County to flush out these false & fabricated filings? There are going to be massive problems in our public land records unless these issues are addressed and resolved.
"These practices are creating fundamental instability in the title/real estate market because foreclosure judgments and title to property based on those judgments are voidable….attorneys will spend years pulling through the records then filing cases to have the judgments and the titles vacated. The bigger constitutional question in my mind is when the Supreme Court makes findings of fact that Florida Courts are accepting and relying on fradulent evidence, yet looking the other way and doing nothing…we have due process violations that will further undermine the courts." -Matt Weidner
And the logic behind doing a short sale makes no sense either. Ask any Realtor in Brevard County just how fun it is to work on a short sale deal for 8 months, only to have the "servicer" cancel the deal two days prior to closing. Let's find out from the Melbourne & Space Coast Association of Realtors how their members feel about doing "short sales." But you see, only the REAL CREDITOR has the right to sign off on any true sale, so who RELEASES THE LIEN? If you don't have a release of lien from the REAL CREDITOR you have ABSOLUTELY NOTHING!
Sir if you are not the proper person to report fraud to (like it states on your website) then where else can members of the public go to report these actions (crimes) aka scams? If you are unwilling or unable to audit our public land records to protect the citizens of Brevard County then we need to implement Judicial Review of our public recordings. How do we begin the process?
712.08 Filing false claim –
No person shall use the privilege of filing notices hereunder for the purpose of asserting false or fictitious claims to land; and in any action relating thereto if the court shall find that any person has filed a false or fictitious claim, the court may award to the prevailing party all costs incurred by her or him in such action, including a reasonable attorney’s fee, and in addition thereto may award to the prevailing party all damages that she or he may have sustained as a result of the filing of such notice of claim.
Question; doesn’t this provision protect property owners from these bogus AOM’S?
Still not convinced;

That will be $100 down and a final bill of probably $100 more, $20 an hour. That is probably less than what you'll burn in time but we are most likely the cheapest source of doing this in the county.

> That said there are limits and when you want them all we have to look at them all.
>
> When you decide what you want we'll be glad to invite you and your attorney to watch. Brian and Richard in Data, and maybe Mike, will be pulling the e-mails. Renee and Carlene will get to read through them.

> I have no idea as well about what you claim are the errors in your case, we'll be glad to check and see if there is something to be fixed if we know what case to check.

> Since I do not know your true name or your case number I have no idea how to search it, much less how to notify your lender to send you paperwork. The title discussion was with another of your e-mail pseudonyms, but I will say again what I said then, if you do not pay a mortgage and attempt to keep the property through legal shenanigans it is unethical and dishonest. Period. You know you borrowed the money, you know the house was the collateral, you know you have not paid the payments, and you know the lender can take back the collateral when you default on the loan.
>
> The Press is here on the e-mails, perhaps you should explain to them your legal theories about how you can the property and not pay the lender on the note.

> It's hard to believe that ALL of the information Plaintiff's Attorney has sent to me lists my address correctly yet your office had my address INCORRECT on the docket. This IN ADDITION to three named entities on the docket that DO NOT APPEAR on my complaint. It is also odd that I received a Notice of Lis Pendens, Summons and Complaint shortly after opening a discussion with you re: TOXIC TITLE (within two weeks). These errors are IN ADDITION to the fake assignment of mortgage and doctored notes (two different versions) that appear as exhibits.

> Sir, your website has a place where citizens of Brevard County can report fraud... if you are not able or willing to listen and investigate then what needs to happen to commence JUDICIAL REVIEW of the AOM's & DOM's and certain exhibits being put on record? How does that process begin?

> According to the FBI, Property and Mortgage Fraud is the fastest growing white-collar crime. It can be as simple as someone recording a fraudulent document in the County land Records office making it look like they now own your home or property.
>
> To address these concerns, John Warren, Dallas County Clerk has joined with Fidlar Technologies to create a service that will help you combat the effects of Land fraud and other similar fraudulent activities.

> It has not been done that I recall. We went through various requests the last few years of similar type but not asking for everything. I would expect it will take at least hundreds of dollars to read through thousands of e-mails. We just did a request for someone else, same type of blanket request but narrow enough for us to know none of the e-mails would involve personnel or juvenile issues.

> This request as written will be extremely costly. I recieve and send almost 100,000 e-mails per year. There is no way to have someone read every one of them and try to determine which are county business, by whatever definition you have of county business. To do would require unknown hours of employee time.
