Realtor doing short sale, bypassing the banks and selling directly to mortgage company

I asked a realtor in Green Valley-Tucson, AZ, to do a short sale of my house as my mortgage company suggested..
It is high season here so people usually buy at the first of the high season or look around and buy in April, just like Florida.

My realtor sold my home within 4 days. I am ill so I told her from the start it would take some doing to get me out fast.
She pushed me to get out, from selling date of Nov 3rh, to make sure I was out of the home by Dec 31st. How can paperwork be done from Nov 3rd to Dec 31st? And be finished. She was confident it would happen within that timeframe.

She told me that they were going to bypass the mortgage company since the mortgage company could not figure out if the loan was through chase or wells fargo.

They were simply going to go through the mortgage company, EMC.


After days of not sleeping over this, I told them that Dec 31st was unrealistic and the buyer backed out.

But it remains: Was the realtor and EMC willing to do something illegal to satisfy a sale.?

Is this not fraudulant?

Thanks for your insight, james. Due to this site, I called EMC mortgage, explained what the sales person was doing and they gave me the scoop. It would be illegal for her to sell the property to the mortgage company. As well as many other things she said , they agreed that the sales person was wrong and to fire her. I did. Thanks.

Sounds like they want you out of your house!!!! I would seriously question any process that seems; "If it is too good to be true, it probably isn't true!"

When the house sells again, on short sell, with a different buyer, I need to make sure that I have a note from Chase showing it owns the home? Right now I have paperwork going to emc, chase and WF. This realtor is on the ball and pushy. If I ask her about Emc buying it, she says it is ok. So It is up to me to find out the info. Thanks you for your info. I will write Chase again and ask for proof. I have asked EMC mortgage with no response. Thank you. I woujld prefer to stop the short sale and go straight to foreclosure to get rid of the home that is right by a copper mine that makes people ill from toxins and the realtor does not disclose.

Sometimes if you have people on the ball purchases can happen in 15 days or less. As far as I know Chase owns EMC. So that shouldn't make a difference...As far as WF being involved tell them both to prove up! PROVE UP OR SHUT UP...WARNING ....THEY WILL STILL STEAL YOUR HOME! IF you have a way out and save yourself the time and headache of a hard battle you maybe better off...Some how they will have to prove who has the right to receive your payoff...

Maybe check and see if there's a NACA office by you. Their attorneys who dont get paid until they perform usually. But there are some that are corrupt thru them as well...Naca.net
