Less Than 48 Hours Till Sherrifs Sale

I am getting Dangerously close to my home of 21 years being sold out from under our feet.Last Night I Sent A  email to the Trustee Service That Is Handling the auction of my home, Here Is A Copy: I have removed delicate info for obvious reasons
Hello My Name Is Gang 3,
I live at xxxxxx S.E.xx  avenue XXX ,Oregon 972XX.
I have a mortgage with Beneficial Finance, My mortgage originated  Feburary 07,2001 for the original amount of $ 133,704.42, And  early on in our mortgage I started to notice
discrepancies  in the accounting of our Mortgage payments and balances. Its Always been this way. And We have never received our regular monthly statements
So it was always very difficult to check things out, As to why so many late or missing payments always seemed to happen to us.
   As this foreclosure started drawing near I really became concerned as anyone would. After closely looking at our documents I have realized quite a few problems.
One that really bothers me is the fact that Beneficial Finance has kept two sets of records for our account. This is really troubling to us.
Due to the fact they are determined to foreclose on our home of 21 years. Knowing the fact there are two sets of accounts for the very same mortgage.
As we only have 1 main  first mortgage. I am attaching two documents to this email I only pray you will take the time to review these and let me know how
Your office of Trustee`s can justify auctioning off our home this coming week February. 03-2011 knowing there are indeed at least two different account numbers for
the very same mortgage loan? These Are not the only concerns I have, I am looking for a qualified professional
to do a Through Audit of our Mortgage, With The Loan numbers of  661708 522359  And   661708-005224124  these two numbers have been continuously referenced thru out the term of our mortgage,
in rotation with no apparent pattern. Some of my documents will have one account number , Then some others will have the other account number. I really do  not understand
How any one could claim with any amount of certainty  how our payments have actually been applied over the years. And We are talking about a family`s home here. This is not taken lightly by me.
Because I know for a fact just by the documents in my possession this is not a one time typo. It Has consistently occurred throughout the life of the loan.
Please take the time to look at these two documents I am attaching to this email.     Respectfully  Gang 3

I asked for a QWR a few months back, Specifically requesting something readable by a human being,What I received was a computer generated bunch of pages of in house code .

That was impossible  for me to decipher.But what I do know is,My bookkeeping and theirs differ by over $ 60,000.00 and they have had me in arrears for over 10 years. but will not furnish monthly statements, I had a regular monthly statement since at least 1996. they refused any more payments from me in late 2009,But demand I pay up all arrears or they will foreclose, And now they have. I tried chapter 13 only to have it dismissed in the first 45 days,Due to not feasible (unable to pay arrears in the 5 year life of chapter 13  plan, and also pay normal mortgage maintenance payments. With my income ) but I know I do not owe that much arrears as they claim.But In non judicial Oregon,And no way to file adversary claim thru B.K. 13 I`m just about screwed

You NEED to go to the auction!! When they start their bidding on your house, you NEED to sound off LOUD and CLEAR. "THEY DO NOT HAVE THE RIGHT TO AUCTION MY HOUSE!! THEY DON'T OWN MY HOUSE!! THEY DON'T HAVE A CLEAR TITLE, AND I'LL SEE YOU ALL IN COURT!!"   Let us know

what happens.  (You have to raise HELL)

It appears, and it is quite possible, that you have been double dipped, aka, a 1st Lien & a 2nd Lien, the 2nd unbeknownst to you.

A QWR requesting all documents for both,(supposed) loan numbers to the foreclosing entity and/or the originator, if not the same entities, will shed a little more on this. A QWR must be answered and is available to you in your mortgage docs.

At this late date, you should, 1. Find a lawyer, if at all possible that "GETS IT", 2. Get a QWR in the mail tomorrow and bring a copy of the QWR and the USPS Certified Return Receipt Request card from the post office to the court and ask for an extension for discovery.
