In Re Wilson: Louisiana BK case involving possible sanctions LPS

The Wilson case is perhaps among the most important cases in foreclosure land, yet it has been getting very little notice or attention by foreclosure fighters, the defensive BAR, and the media.

At present LPS has had a motion for sanctions filed against it by the US Trustee. An employee of LPS, Dory Goebel, executed an affidavit in the case that was proven to be false (and this well in advance of the recent breaking robo-signer story). Goebel was subpoenaed to appear and failed to d so. For this she was ultimately sanctioned by Judge Magner (see the order granting sanctions of July 11, 2008 at the links below).

Upon inquiry into the lies of Goebel LPS appears to have tried to cover lies by telling more lies. This has, er, um, upset the US Trustee and that officer of the court has sought sanctions against LPS, Option One Mortgage Corp, and the Boles law firm (these latter 2 parties are no longer a party to the motion though by what means they extricated themselves I can't say).

At present this motion for sanctions is due to be heard on December 1, 2010. Magner, having already sanctioned Option One and Goebel, is showing signs that 1) she understands the role of LPS and its bad deeds and 2) is very willing to sanction bad players when presented in her court.

LPS is involved in 70% of the foreclosures nationwide. In the present climate I would think the sanctioning of LPS, in any amount, for telling lies to a Federal Judge will have a very deep impact.

Here's an update...  DOJ (US Trustee) "LPS/Fidelity acted with indifference to the truth" and bankruptcy court sanctions are warranted to deter abuse of process

Can you say "Contract perjuerers and forgers" boys and girls?

LPS was mentioned in the NYT, in an Op-Ed by Yves Smith of Naked Capitalism, yesterday:

"Other serious abuses are coming to light. Consider a company called Lender Processing Services, which acts as a middleman for mortgage servicers and says it oversees more than half the foreclosures in the United States. To assist foreclosure law firms in its network, a subsidiary of the company offered a menu of services it provided for a fee.

The list showed prices for “creating” — that is, conjuring from thin air — various documents that the trust owning the loan should already have on hand. The firm even offered to create a “collateral file,” which contained all the documents needed to establish ownership of a particular real estate loan. Equipped with a collateral file, you could likely persuade a court that you were entitled to foreclose on a house even if you had never owned the loan."
