These sayings can apply to us Foreclosure Fighters if we continue to make the same mistakes in our pleadings and oral arguments in court. Let me explain...I am not saying WE are incredibly stupid...but perhaps we would be if we keep trying the same things and failing time after time after time!!! If we are making mistakes that are leading to the loss of court cases, I suggest that we look at what the judges are saying and use that to modify our approach so that we can circumvent their roadblocks!
Face it. We are in a boxing ring in which they make the rules. They have their own set of rules for THEM, and there is another set of rules for US that are, for the most part, "unspoken". We know the "real" laws. We know what's right. But when we play by the CORRECT rules...somehow we are losing most of the time...
SO...we need to learn their so-called rules (which aggravates me to no end, as it does all of us, because it is so wrong, illegal, unjust and unfair), but if we use their own rules against them...perhaps...PERHAPS we can out-smart them at their own game, which they devised to cheat us out of our property and homes!
I am requesting all of you to start hitting the law books (available online, too) and studying up so we can put all our ideas and facts out on the table and stratagize to beat them at their own (albeit unfair) game.
There are many concepts based in real law and facts...
BUT THE COURTS ARE NOT SEEING IT!
We need to study WHY they are denying the facts and laws we are presenting to them?
WHY IS IT THAT THEY ARE NOT RULING ACCORDING TO THE LAW???
Please, would you who are able to start studying the decisions of the judges on cases they have ruled in favor of the banks and AGAINST the HOMEOWNER...to use as "clues" to help us perfect our pleadings and arguments in court!
As you can tell, I am upset...and all of us get this way now and again, so forgive me for "ranting" a tad...or a LOT!
A personal note: I am 11 days away from a Summary Judgment in a "Slaughter House" eviction proceeding and every avenue taken is shot down! I have few last-ditch efforts to avoid eviction, and by all means, I am going to utilize them! Cross-complaint, another Removal to Federal court, bankruptcy...and
if the bank wins and I lose, I'll be one of those "Homeless Homeowners" I spoke of in my earlier blog!!!
...but what upsets me the most in my case is WHY and HOW IT GOT THIS FAR SO FAST! We fought like mad and had all the right arguments and case law citations YET STILL HAD OUR HOME SOLD AT A TRUSTEE'S SALE!
Concepts, Laws, theories, etc...need to be applied in real-life cases!
I am doing my best to spread the word for Homeowners to catch their loan problems before they get in such a desperate situation like mine, where I fought them on the foreclosure and lost, but was bullied into a corner in an eviction proceeding in a short amount of time!
So again, I repeat:
I request all of you to start hitting the law books and studying up the decisions why cases are not winning so we can put all our ideas and facts out on the table and stratagize to beat them at their own (albeit unfair) game.
