Hey guys, today while talking to Captain Jack about his lender's motion to dismissed, he mentioned filing some type of motion to stop the lender from any further proceedings against him. It was then that I remembered how I had stopped my lender from stealing my home. On the very day before my home was supposed to be auctioned off, I had an emergency motion for preliminary injunction. The motion basically argues that the lender had no lawful authority to foreclose on my home and I seek the court's protection pending the resolution of the dispute; There is a Public Interest argument at issue here. Foreclosure hurts the public. That is one of the biggest issue the judge looked at. Would my foreclosure affect my neighbor and the public in any adverse way, and does it infringe on any law which protects the public.
I won my injunction in August 2007, based especially on my Public interest arguments to the court. However after I won the injunction to block the foreclosure and my lender offered me a modification but denied my request to give everyone else the same deal, the judge had to dismiss the injunction because now it was I who was refusing to settle. To make the story shorter, exactly one day before the lender was about to sell my home again, I had another motion for preliminary injunction, this time in the federal court.
