I MET WITH AN ASSEMBLYWOMAN FROM MY DISTRICT. SHE READ THE MATERIALS I PROVIDED TO HER ABOUT THE NEW ARIZONA LAW RECENTLY PASSED WHICH MAKES IT MANDATORY FOR ANY FORECLOSING ENTITY TO PROVE A CLEAR CHAIN OF TITLE BEFORE PURSUING A NON-JUDICIAL FORECLOSURE. WE NEED THE SAME FOR CALIFORNIANS.
EVEN THOUGH YOU MAY NOT BE HER CONSTITUENT, SHE IS CHAIR OF THE CONSUMER PROTECTION BUREAU FOR THE STATE OF CALIFORNIA STATE LEGISTLATURE.
SHE SAID SHE WAS INTRIGUED BY THE NEW ARIZONA LAW, BUT SAID SHE COULD DO NOTHING BASED ON WHAT ONE PERSON (ME) WAS TELLING HER.
I URGENTLY NEED YOUR ASSISTANCE BY ADDING YOUR NAME & CONTACT INFORMATION TO THE LETTER TEMPLATE, AND MODIFY IT IF YOU WISH, AND FAX IT TO HER AS SOON AS POSSIBLE. YOU CAN ASK FOR EMERGENCY LEGISLATION TOO.

Dear Assemblywoman Hayashi:
I understand that Anita Carr met with you on March 18, 2011 in your District Office to request that you strongly support sponsoring a law similar to the one passed by the Arizona legislature AZ Senate Bill 1259.
I understand that I may not be a constituent in your district, but since you are the Chair of the Consumer Protection Bureau, I believe you are the correct person to notify.
Thousands of Californians are being fraudulently stripped of their homes by unscrupulous banks ramming through non-judicial foreclosures by posing as the true lender and/or true creditor, when in fact, they are NOT the lender or the creditor.
Californians need the same tough law as Arizona passed which makes it the law that any entity foreclosing, a bank or otherwise, must prove a clear chain of title before starting any foreclosure and it must be proven without the use of fraudulent and/or forged documents.
Currently, these foreclosing entities are filing at the county recorder’s offices and with the courts fraudulent and forged documents so they can ‘rob’ homeowners of their homes.
An emergency law could be sponsored now. I strongly suggest you hold a ‘town hall’ type meeting and invite some Californians struggling to save their homes who are having to deal with nightmarish wall street firms who securitized their mortgages and sold slices of the mortgage as a bond to investors around the world.
Do not look to Washington DC to help Californians. The foreclosure laws are state specific.
The State AGs are not helping us with their weak settlements.
