Back To The Future: Time Travel With Ocwen

So, here we have a post-foreclosure looksee at the mortgage assignment from/to the foreclosing entity, Ocwen.


On 2/25/2009, this assignment of mortgage was notarized in Palm Beach County by Florida notary Leticia N. Arlas. It was then recorded in the Haralson County, GA public official records book 869, page 554.



The signing agent of Residential Loan Servicing, Ocwen Loan Servicing as attorney-in-fact-for was Scott Anderson, Senior Vice President.



Denise A. Marvel, Manager of Document Control and Contract Management signed under "Attested By".


Witnesses were Oscar Traveras and Doris Chapman.



This document was "prepared" by Maria Alverez of Ocwen Loan Servicing (1661 Worthington Road, Suite 100, West Palm Beach, FL 33409. ph: 651-682-8835)

Assignment "made and entered": 5/1/2005



Property/Asset transfer from HomeAmerican Credit D/B/A Upland Mortgage whose address is Ocwen Loan Servicing 1661 Worthington Road, Suite 100, West Palm Beach, FL 33409 (the "Assignor")


Property/Asset transfer to Deutsche Bank National Trust Company, As Indentrue Trustee for the Registered Holders of Ocwen Real Estate Asset Liquidating Trust 2001-1, Asset-Backed Notes Series 2007-1, whose address is c/o Ocwen Loan Servicing 1661 Worthington Road, Suite 100, West Palm Beach, FL 33409 (the "Assignee").



So, it's from and to the same company. But can't be, right?



It was assigned in 2009, but backdated to be effective in 2005 to be assigned to a trust that would not even exist for another TWO YEARS (2007). Being no math whiz, would someone please clarify if that is a net back-dating of two years? Perhaps it's a cumulative formula, adding the 4 years back to the 2 years forward calculating the "off dating" to a total of 6 years? I dunno? How's this work?



Ocwen? What say ye?


Start in 2009. Go back to 2005. Foresee the creation of a trust and "future assign" the mortgage 2 years into the future.

ANY Reputable Title & Escrow Company would surely VERIFY TRUST EXISTENCE AND POA GIVEN BY TRUST TO SIGNING AGENT... why don't courts do the same?
