Off on another tangent, a Florida foreclosure defense attorney & I were discussing a case where the loan was found in a different trust than the one the SEC stated held the loan.
We pulled up the trust that the SEC specified, Wells Fargo Alternate Loan 2007-PA5 Trust (prospectus is here)
We marveled at the amount of information, the number of loans, the MERS numbers, the states & counties that had properties affected by this investment "vehicle", this "financial innovation".
I played a little game, trying to find the mortgages of a few Florida properties to see if there were foreclosures pending.
I found a few, and YESSIREE--foreclosures (more on that in a later post).
One curious thing is the high number of MERS MIN Numbers of high dollar loans that aren't valid numbers.

When one looks up the loans originated by Wells Fargo (first seven digits of MERSMIN is 1000113) at the lookup tool for MERS MIN numbers here, this message in red appears: No MINs can be located that match the search criteria entered. I picked out 50 loans valued at one million or more. I got the same results for Wells Fargo originated loans of lower values.

On the one I have (very similar ) Started with Wachovia (land loan) Mers system MIN # inactive now but listed anyway. Then a Construction loan Wachovia as well in Feb 2007 I thought but it shows up as Wachovia/Wells Fargo there even though Wells Didn't own Wachovia at that time when I move home to property (with this loan to put back together home there) then the fun starts Still listed as Active in Mers File as of March 2011. Next can a perm loan done with GB&T May 2007 for CO to move in to live legally there. Taht loan was never recorded in Deed and record room county of Gwinnett, Ga, Yet in July BB&T shows up in Mers system (now inactive 0 July of 2007 recorded and then in March of 2008 HSBC REFI loan listed in Mers system (inactive now) 2011 and the refi closing BB&T was paid off loan by HSBC but in Mers it shows HSBC as servicer and Investor as Fannie Mae as of March 27, 2008 date of last loan Yet on November 2, 2009 an assignment from Mers claiming ownership transfers it to HSBC so HSBC could get an automatic stay from Bankruptcy court to allow them to do a foreclosure on the property. Yet HSBC claimed they owned the home/property in September when they contested the matter of BK yet not until November did the Assignment appear. To really complicate the entire issue I didn't do the REFI an x girlfriend did and as her proof of ownership she signed her own Bill of Sale by signing My Name transferring My home to her which she then got the REFI from HSBC. Confused yet. If Fannie mae is the investor of the REFI loan as (owner) *(trust) how in the world could HSBC even with a Mers (doesn't own anything , never collects anything and basically hiding everything in their data box) sign over anything to HSBC cause HSBC is only the debt collector for Investor trust Fannie Mae. Fannie May Memo told all Foreclosure Attorneys do not foreclose in our name (PR) Uncle Sam is taking families homes. Not too good PR .
any body got any thoughts I do since I read this : I think loans were sold multi times and now the crap is being exposed and this just may be the stick that breaks the back of the Big Banks cause if one was doing it you can best bet there are others doing the same thing. All of which are Felonies and Executives not the poor average joe could figure this one out. Bernie Where are you. Help explain this mess.

Comment by Phred Maldonaldo on March 17, 2011 at 12:23am Maybe you tripped over the 'loans' made to the 10's of thousands of judges across the country that have loan documents that say one amount, and assessors that have a lesser amount. The 'investors' are the campaign contributors who won't declare a 'default' or 'breach' as long as the judgments are 'consistent'.
On the other hand, it could just be that the invalid MIN numbers are for the Wells Fargo 'house' accounts that use a subset of the MIN number in its own data tracking system.

SO WHY ALL THE LOST NOTES - THE CUSTODIAN HAS THEM, RIGHT?
WHY THE ROCKET DOCKET, YOU CAN GET BY ON THE MERITS OF YOUR CASE, RIGHT PLAINTIFF (wink wink)?
Are the investor class action lawsuits picking up on the fact that these trusts were largely "dark" (vacant trusts) and that the debt was/is unsecured?
