A Frank Chat About The Fraud... G-rated

The tremendous amount of frustration, fear, and confusion being felt by homeowners facing foreclosure across the country is further compounded by the fact that there is fraud being perpetrated on them by the banks, the lenders, and the servicers, with most judges looking the other way.

Excerpts from a chat conversation* here at the Hamlet reveal some of these emotions, with the issues of fraud being clearly defined in a surprisingly frank way by those who are directly impacted by them. (*Names have been changed to protect the innocent, and minor editing was done to remove extraneous chat and chat from other members. All misspellings and grammatical errors were left intact, and emphasis was added.)

Here is that chat:

velma: it seems like the state and fed govt are ignoring the fraud thats going on. i showed my ag's office the fraud and they said to try and mod again

velma: it appears the BK judges get this better then the 4closure ones

louisa: LOL, MOD,, what the frick

velma: i asked why should i mod again when no one has clear title to the loan and theyre answer was "well, someone does"... so i replied well not on paper they dont lol

louisa: it's like payin high rent for a house U will never own

louisa: The trick is to keep U on the Hamster wheel

velma: well the real kicker was the title examiner telling me i cant even short sale my home because of the title defects. i dont want to but if i did i couldnt

louisa: so Why MOD, the title is crap

velma: it seems like all the laws were written to nail the consumer for screwing the banks but nothing is in place when they do it to the consumer except a lot of laws with no teeth

velma: they balked when i wrote a qualified written request proving they have a right to the note or service it... 4 times

louisa: U want to see the real power struct ur up against
structure

velma: told me the info was proprietary and confidential, i had no right to know anything

louisa: not true

velma: i know the power structure lol.

velma: according to them they dont have to prove anything other than things related to the servicing of my note. my argument was and always has been that standing is the core of the issue and without they have no right doing what theyre doing... so prove it

chap-under-40: told me , the only way I was going to get the info was by subpeana , so thats what their going to get

velma: they essentially told me the same thing... i have to use proper "discovery" to get to the bottom of it.. which pretty much means ":sue me" if you want it

louisa: RESPA violarion for non response is 1,000 I believe

chap-under-40: told them that, they said they have answered everything they have to lol

chap-under-40: Which was nothing

louisa: this will consume your time

louisa: I don't see how anybody can do this pro se and work

velma: the other thing is why would BankZ and their lawyer send me a copy of my mortgage, but they are different...

louisa: dunno,, can U get a Stay?

velma: by different i mean on BankZ's copy the signatures dont match the copies of their attorneys

velma: non-judicial state, the only stay i can get is an injunction, and you need a lawyer for that

louisa: all the paperwork is a fraud, U need to stop that sale

velma: on the lawyers copy i initial and sign first, then on BankZ my wifes goes first. the signatures are in reverse

louisa: all the paperwork is a fraud,

velma: funny thing BankZ gave me a copy that had "true and attested copy" stamoped on it but it doesnt even match the one recorded at the registry if deeds for my county lol

louisa: same response

velma: now the attorney is claiming an allonge conveyed my note lol

velma: why would they have 2 differing copies of my mortgage? i asked them and they were "uh uh.." and i didnt get a straight answer

velma: then their attorney flat out denied it, saying there is only one

louisa: cuz it's all a fraud and a sloppy one at that

velma: and how can they deposit a nonperforming loan into a trust in 2010 that closed in 2006 lol they cant. i read the trusts propesctus

louisa: they can't

velma: i know but its on record that they did, at least by slight of hand, in 2010

velma: they didnt even backdating it, they put the right date on it

velma: it bewilders me that attorneys are jumping all over this. the liability and damages are astronomical

velma: they all say the same thing... file bankruptcy

velma: i say why? if they cant prove they own it, and are on record committing fraud then call them to task

construct-shun: y file bk if u dont have too

velma: in my state you do if they foreclose. they dont have to prove anything just file a complaint and take your house, non-judicial

velma: judges rubber stamp the complaints and say next

construct-shun: ok so what happens if you contest?

velma: talked to one lawyer who wants 6 grand down and 10 percent of my homes value if he prevails at the end... i laughed

velma: i cant contest

velma:we have no recourse here

construct-shun: sue them

velma:other than filing a civil suit and getting an injunction outside the land courts

construct-shun: thats ur recourse

seltzer: A few moths ago the percentage of homeowners thaqt decided to stay and fight was under 10%
