This bill is set for a vote in Committee this week and the Democrats will be the ones to squash it. From a good source I understand the Committee Chair, Representative Angela Williams is listening to the American Bankers Association. She is trying to tell homeowners that have lost their home that the bill is too broad. If you live in Colorado take a moment and call Representative Angela Williams especially if you live in District 7.

This is by far the best explanation of the foreclosure crisis I have heard. I take exception to a couple of things he said like the property taxes stop being paid. The servicers continue to pay the taxes but they are charged to the investors and or pension funds. This is an excellent article on REMICs (Real Estate Mortgage Investment Conduits). It basically says that the 12 dirtiest banks may owe close to a trillion dollars in back taxes. This is because in order to benefit from tax exempt status for their REMICs they must be moved into the trust within 90 days. As we are all aware that never happened in most cases. This is definitely a story to follow.

This is a very important ruling if you live in Colorado and fighting a foreclosure. This is the Tenth Circuit Court and it clarifies UCC code as it related to Colorado, the 120 hearing, Qualified Holder and much more. It’s a must real for all Colorado homeowners that want to know their rights.
