i have to share some important tax information with everyone. did my taxes online with H&R block but the EIC did not come out right i have 3 children. my husband is on unemployment it cam out at 915? everywhere i looked online unemployment is not income. I was listening to rob harrington when he spoke about activism i beleive we need to start at the grass roots all of us in our communities. If anyone in the Tampa bay area would like to start a meeting? it can be once a month even. just so we can meet maybe at at a restaurant. have discussion and ease minds. i think feeling alone in this mess is the problem. we can pick a place near everyone. any suggestions. Hi Saving. I am not really sure how I did it really. I blindly went into this with your basic show me your note defense just to buy myself time. Then it turned into an all out battle to the death so to speak. The attorney they are using is relentless. I tried many attempts to work with the boa before and during the foreclosure. I think one of the biggest things I did was manage to get the courts to look at me as a person, and not just some case number in foreclosure. I spelled everything out to the courts about all my attempts to work with the bank as well as their attorney to no avail. Then, the banks last attempt at summery judgement they added 3 signatures from countrywide to the copy of the note and tried to pass it along as real. I brought that to the courts attention and had it thrown out. I did attempt to get them to instate fraud charges but was not successful. At that point, however, the judge ordered the plaintiff to produce the actual signed ink note in court. The plaintiff was/is not able to do so, so the case has been dismissed. Albeit, without prejudice, but I still see it as a small victory. I do expect however the bank to try again to foreclose on me but since it went to this point more than likely, unless they can physically produce the note it will not go through.
Hello saving, I posted yesterday, that BOA served us again, they filed a assignment in april, while trying to work out mod, and of course same all crap, you need this paper, you need that paper, although we sent it three different times. I lost 2 homes back to back. Lawyer I hired back on June 2009, did absolutely nothing. I filed complaint with d.c. Bar association after I filed, I was told he was not liscense in Virginia & Florida.

So, obviously at that point they understood your computer files where lost. Correct? And you told them, no you are not willing to begin resubmission. Which, let's face it, they've heard this story many times over, they know what is going on, they know why you don't want to jump through hoops just for them to deny you in the end. They will end up foreclosing anyway. You did the right thing. Make them serve the damn papers. So.
Have they served the papers?
Who did you retain as Counsel?

Don't be scared. When is your court date? Florida is one of the most 'aware' states, so, say your prayers, don't be scared. OK?
For whatever reason HAMP was created, and I agree with you, if consumers are told to "stop payments" because they "must be in default" to qualify for the program, something is terribly wrong with the program.
In my experience, you must be proactive with Wells Fargo. Don't believe any of the lies, or strings of lies, they tell you about your promised modification. They are squeezing your every last dime out of you giving your false hope before they foreclose and steal your home from you anyway. All those extra payments you have made that they haven't applied to your account yet, those payments they've kept in that "suspense account" while you are waiting for the approval on your modification? Wells Fargo keeps when your modification is ultimately denied. You say, "That's not legal." No, it isn't. But Wells Fargo is betting on the fact that you won't take them to Court. Most homeowners simply walk away.
How to fight back? Start looking for problems in your documents. Believe me, you'll find them. Fraud exists in most mortgage loan documents. Robo-signing, notary fraud (notary not licensed at the time they signed the document), improbable dates, signature dates not matching document dates, notary dates not matching the signatures dates, MERS (MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC.) ASSIGNMENTS ALWAYS A BIG RED FLAG, and if your documents say they were prepared by DOCX in the upper right hand corner on them ANYWHERE, your documents are almost definitely fraudulent.
If you find any of these to be the case, either e-mail me, or e-mail anyone on this site, for additional guidance on what steps to take next to fight your lender to keep your home.
