Mortgage company states it does not hold the original note. "lost,stolen, or destroyed" can they legally foreclose on my property in fl.?

orlando - have a rental - summary judgement 8/10/09 hoping to find attorney to file motion to vacate judgement - assgnmnet fraud -lots of other issues wells fargo/ahmsi

primary residence shapiro fishman/deutsche case open almost 2 years
just changed servicer from saxon and ocwen and within a flash they
have filed for sjudgment
