In Re Wilson: Louisiana BK case involving possible sanctions LPS

The Wilson case is perhaps among the most important cases in foreclosure land, yet it has been getting very little notice or attention by foreclosure fighters, the defensive BAR, and the media. At present LPS has had a motion for sanctions filed against it by the US Trustee. An employee of LPS, Dory Goebel, executed an affidavit in the case that was proven to be false (and this well in advance of the recent breaking robo-signer story). Goebel was subpoenaed to appear and failed to d so. For this…See More

URGENT CALL for affidavits executed by LPS

Hello Hamleteers, What a whirlwind couple of weeks. And it is still picking up steam!!Presently I have an urgent call/need for documents executed by Lender Processing Services (LPS) AFTER September 2008. Do not be confused with the Alpharetta, Georgia company DOCX. LPS is attempting to distance itself from DOCX by claiming it is merely a subsidiary, or an outsourced service provider. This call/need is specifically for Lender Processing Services documents from either the Mendota Heights Mn.…See More

LPS to be sanctioned by US Bankruptcy Judge Elizabeth Magner in the case of In Re Wilson

Posted on April 14, 2011 at 2:57pm 0 Comments

This has been the case I've been watching for a long time, beginning in early summer of 2008.

The understanding of the US Trustee has been crucial, as has his/her doggedness. As well Judge Elizabeth Magner deserves a tremendous amount of credit for first being tolerant of the US Trustee, and once she began to understand what LPS was doing…

Standing and jurisdiction in Florida Courts

Posted on February 7, 2011 at 5:53pm 1 Comment

I was poking around the Florida Constitution this afternoon and found the section I believe grants standing and jurisdiction to the courts, or rather grants standing to a plaintiff to invoke the jurisdiction of the court.

Article I, Section 21 states:

 Access to courts.The…

NJ Appellate - DBNT v. Wilson - Evidentiary Rules

Posted on February 2, 2011 at 1:39pm 0 Comments

I came across this NJ Appellate Court decision this afternoon, available at:

http://www.scribd.com/doc/47842733/DBNT-v-Wilson-w?autodown=pdf

The panel has, in my lay opinion, ruled correctly on the evidentiary issues. Despite appearances this decision does not revolve around the robo-signing issue. It revolves around the rules of evidence and plaintiffs failure to submit its… Continue

History of the Statute of Frauds

Posted on January 15, 2011 at 1:12pm 0 Comments

I found some interesting "stuff" regarding the history of the statute of frauds. As well another source came up with something additional. I'm merely posting the links here. Without additional commentary I recommend giving these a read.

We concur - litigate one case at a time - many multiple clients same bank - but ultimately better results.  Class Action issues are too diverse.
