O. Max Gardner III is the founder of Max Gardner’s Bankruptcy Boot Camps, the premier seminar series in America for consumer bankruptcy lawyers. Business Week calls Mr. Gardner the “go to person in the United States for all bankruptcy issues”. Gardner’s works and cases have been featured in the NY Times, the Washington Post, and the Atlanta Constitution and on CNN, NBC and CBS. His Boot Camps were featured on a special edition of ABC’s “Nightline News.”
Gardner received his undergraduate degree from the University of North Carolina at Chapel Hill in 1969 and graduated with High Honors from the UNC School of Law in 1974. He was the Outstanding Law Graduate of 1974 and a member of the Order of the Coif. Following graduation he served as the Senior Law Clerk to the Hon. William H. Bobbitt, the late Chief Justice of the North Carolina Supreme Court, and as Senior Law Clerk to the Hon. William Copeland, an Associate Justice of that Court.
Following his clerkships, Mr. Gardner worked for three years with the Smith Moore law firm in Greensboro, North Carolina. He later served as “Of Counsel” to the Washington law firm of Sims, Walker & Steinfeld. During his Washington years, Mr. Gardner worked on thousands of cases involving the Federal Trade Commission, the Interstate Commerce Commission and the United States Bankruptcy Code. Gardner was Special Counsel to Chapter 7 Trustees in national ICC litigation and in one emergency case personally filed more than 1,000 adversary proceedings in one week so as to protect the Trustee from statute of limitation issues.
During his years of practice, Gardner has tried 102 jury cases to a final verdict. Gardner currently limits his practice to consumer bankruptcy cases and all consumer claims arising with respect to those cases. He has been recognized by Gretchen Morgenstern of the New York Times as one of the leading consumer attorneys in America on “predatory mortgage servicing” in Chapter 13 bankruptcy cases.
Gardner was named the Outstanding Consumer Lawyer of 2004 by the National Association of Consumer Bankruptcy Attorneys (NACBA). He has been named as a member of the North Carolina “Legal Elite” four times and is a five time winner of the North Carolina “Super Lawyer” Award. He has an AV rating from Martindale Hubbell and a 10.00 rating from AVVO.
Max and his wife, Victoria, live in the South Mountains of Western North Carolina with their beloved Cavalier King Charles Spaniels and Pacifino horses.

We Have been fighting a bad mortgage servicer for over 12 year from UT Select Portfolio Servicing,my mortgags assignments have been signed by Robo Signers,and will not send the real note,they don't have thats why!

After office of NCBanking Commish told Ocwen to cease and desist and to respond back to me by March 1 with an explanation for their actions - guess what Ocwen's response was? ANOTHER foreclosure notice - demanding 6,000 more than they demanded 2 weeks ago...going to see ANOTHER attorney in a.m. if they suck gonna try your buddy Wayne. (WHY do all attorneys want me to file Bankruptcy when I have no dischargable debt and have missed no house payments?) Sigh. Any encouragement would be apprecciated!
I know. It is just so discouraging - for the corruption to be blatant and totally transparent and the reaction is little more than a collective yawn. I almost got hit by a car on my way to work and for a split second I felt a sense of relief...then disappointment that I was not killed! The last few years have taken a toll on me...I can only imagine the despair those not as "lucky" as I am are feeling. Hopefully I will prevail and will be able to help others through this in the future. Thanks for you comment!
Max - why in NC have we heard nothing from our Banking Commisioner/AG regarding the MERS debaucle? Where are our Register of Deeds? Why are they silent. Other than Thigpen the silence is deafening. Where is our Martha Coakley?

I have been in the consumer fight for more than 25 years. I am NOT afraid of the corruption But Rather afraid of the Victims NOT FIGHTING TOGETHER. Now is the time to FIGHT Together.
Thank you. The NCCB has told them to back off for 2 weeks so I am going to try and find an attorney this week. Thanks...for all you do for consumers. I have gotten a real education throughout all of this - I used to think as long as you do the right thing in this free land nothing bad can happen. It has been a rude awakening...I am grateful that there are still people like you fighting for the little guy...
