Judge Sasser Motion to Dismiss Hearing Tomorrow

Wish me luck. Tomorrow I get me 5 minutes in front of Judge Sasser to argue my motion to dismiss. I'll be arguing, lack of capacity, lack of standing and fraud on the court.The fraud on the court is interesting because they have filed at least 3 false on the face affidavits. One the document was notarized a year before it was created (oops). Ok - the intent of this blog is for Florida Residents to help each other defend our homes. To participate, start by writing specific details about where you are in your case. David Stern Stock Price Tumbles - DJSP

Oh darn! The stock price was around $15 in June and about a buck and a half today. Thats about a 90% drop. Multiple directors resign today. Wonder why!

SUMMARY JUDGMENT DENIED _ PALM BEACH COUNTY JUDGE CARNEY

I had a summary judgment hearing this morning Palm Beach County, Judge Carney. Despite all of the the horror stories, I found the Judge to be well meaning and he quickly got to the heart of the matter.

In my case, even though I had filed affirmative defenses (Thank YOu April Carney). Deutsche had not responded to them. The Judge stated case law stating that Summary Judgment is improper until Affirmative Defenses had been address.

Fair Debt Collections Practices Act (FDCPA) Counterclaims questions/thoughts.

Alright legal eagles I've got a couple of FDCPA thoughts. Comments/questions are encouraged.

1st if the note has been assigned to another company, the new company is a debt collector under the Act.

2nd the act specifically mentions false and illegal charges as against the act with a $1,000 fine per violation.
