IN SEPT 2010 Me and my husband were CURRENT ON MY MORTGAGE!!! we just paid the 5th payment of a wells fargo "in house " modification that was more than my original mortgage that i asked for help with. They kept us on a string from june 2009 to april 2010 losing my paper work at every turn. faxing and refaxing became the new normal back in the fall 2009. i sign a forbearance with wells fargo june 2009. i was denied a hamp loan?? why?? i had not worked for 5 months i do not understand. by sept 2010 i was working in a hospital now "74" miles away. but it was in st petersburg fl, hit hard by the bp oil spill. being an employee i could not claim any relief. i was canceled weekly. my salary severely affected. sept 2010 my husband became ill. we actually still have not collected that month of pay from his former employer, but i was at odds how to pay my mortgage. i did not want to lose my home. i had put the required 20% down and could not walk away. so i called wells fargo. i was told this time that to apply for a hamp loan i had to in eminent default before i could apply. thats funny because just the year before that was not so. i asked questions. i asked for this in writing every person i spoke to refused. i was told once i was in eminent default which meant i was 3 months late they would take my application and i would be approved. well things did not work out that way. i called sept 14th, i called sept 15th. i was scared but they kept telling me i had to be in eminent default. i said ok . little did i know back then they had just caused a promissary estopel by telling me not to pay because i was current. this needs to be proven . apparently never missing a payment on a mortgage since i have been a home owner since 1991 is not enough. i had a 789 credit score before this whole mess started. thats not good either. but having people to testiy to the judge under oath is what we all need. how do we acomplish this. to beat this we need to start a private date base. so that we can be called by each others lawyers and testify what wells fargo has done. not only did they move my file and lose paper work but denied me a hamp loan and put me in foreclosure.
if anyone one has any ideas please either write here or friend me and we can all brainstorm together. but staying by ourselves is not going to help this horrible situation we are finding ourselves in after a lifetime of working.
please hear my plea and help i do not want to lose my home and i do not want anyone else to lose theirs. we need to think of these kids that stressing out over this.

I went down to town hall, to see if real estate tax payment that is due was paid. I got print outs of all payments etc.... and found out some interesting things re: ZC Sterling, and FNIS. They were making the payments.
Also, I got a copy of everything from Title Co. Says right on one sheet, that they wanted a couple "certified" copies of the NOTE, and the Mortgage. Why is that? ( I am being sarcstic). Also, at Land Court, get ceertified copies of your docs, so you can prove that nothing was recorded by anyone. ( Why is MERS exempt from the public document laws I ask?).
My story is too long to tell, but the same as all of yours. WF does nothing but break the law, and do what they want. If you or I did some of what has been done to me, we would be in jail right now.
Also have encountered lawyers, who are unbelievable. I know more about this stuff than they do. Twilight Zone material.

I made a penny (1 cent) bet with an Attorney I spoke to on Friday re: (WF's) next move, I will let you know if I won or not.

LET EVERYONE KNOW ABOUT YOUR MOTHER. GET THE STORY OUT TO ANY TV OR RADIO STATION YOU CAN.
I can tell you that some media will jump on it and others(like the local p****** that run the local newspaper,THE REPORTER, will not even acknowledge your plight) but then you can call them P****** when they dont

Still not giving up. There has to be someone. Still stuck on what to reply back to the OCC for their reply. Wells Fargo sent their reply back and OCC has not even looked at the signed receipts and conversations I documented proving that Wells Fargo lied.

Do you have a copy of the OCC Consent Order to Wells Fargo that was delivered earlier this year(April 2011)? It talks all about what the OCC says they did wrong and what Wells Fargo MUST do. Anything they violate in the process before and after IS A PROBLEM.
I added my response letter to the OCC on my MY DOC's Blog.

I would definitely get someone to determine whether the bank has a right to your house and payment. I got a free mortgage audit from www.inspectoraudit.com These guys are awesome! I have not found anyone that will get this information for FREE to you, it helped me stop a foreclosure a few days before the sale. I am not usually a person to recommend someone, but I think in this case these people helped me and may help someone else who is in trouble when the bank is trying to steal their house. They will give you a FREE AUDIT!!!
When I got my mortgage audit back, I was STUNNED to find out that my Note had been sold into some kind of investment pool, and the bank did not have the right to continue to collect on me, much less foreclose on me. From what I understand that selling the notes into these pools is very complicated and I don't really understand it completely, except that the Note is no longer a Note, the bank cant claim it anymore as a Note, and the bank has already been paid for your mortage!. They try and steal your house after they have been paid for it!! I was upset when the bank started the foreclosure on me, now I am really upset for a different reason, because they are committing fraud on me.
MY FORECLOSURE HAS BEEN STOPPED DEAD IN ITS TRACKS!! The bank was committing fraud on me and trying to take my house and they cant now, I have a lawyer that is using the the audit I got from inspectoraudit.com and he is turning the tables on the bank. I love it and I feel so empowered now! Being on the offensive is much better than being on the defensive. Good Luck with everything
