Foreclosure Hamlet

Supporting, Informing & Connecting People in Foreclosure

Hi, anyone has tried a quiet title action?, because this action definitely will bring the real

institution that has an interest in the property, and is relatively straightforward compared to others foreclosure defenses?   Any thoughts?

I live in a judicial state.

If anyone knows of a quiet title that was won, I would like to know the information so I can check it out. I would like to review the original complaint of the homeowner. So, if any of you know of these successful quiet titles please help all of us and give us the case information.  Thanks.

Check the link below. You will find a real sample case. You can complete a QT as little as 90 days in Florida.

How about any Quiet Title obtained while a foreclosure was in process? I am looking for information on who all is being sued in a QT case.  I would appreciate any help.

Lit,

You can file your QT even while the foreclosure is ongoing. In most foreclosures, the plaintiff is not the original mortgagee. So When you file your QT you put as defendant the original mortgagee instead of the foreclosure plaintiff. Once you get your QT, you have an affirmative defense against the foreclosure. They can't foreclose on a mortgage that has been extinguished. In Florida QT can take as little as 90 days.
