Foreclosure Hamlet

Supporting, Informing & Connecting People in Foreclosure

My home as been pending foreclosure for the past 4 years the lender is claiming lost note and mortgage.  I have filed motion to produce.  To dismiss etc after a year lenders attorney which was Stern office filed an allonge to note which is a copy.  The file was taken away from Sterns office after the attorney general started investigating him.  There is a new attorney on the case since Aprill 2011 but she has not filed anything new.  Friday I receive an order from the court stating there is a Case Management Conference set for July.  Should I file once again Motion to Dismiss for Fraud and violating Discovery Rules on Plaintiff?  I am Pro Se and would like any advice at this time.  Thank you

So in your advice it is better to file a Lack of Prosecution prior to the conference instead of Motion to dismiss?  I was also thinking of filing a Discharge Lis Pendens and Certificate of Title.  I am just confused on which would be appropriate.  Thank you for all your help.  I really appreciate it.
