Foreclosure Hamlet

Supporting, Informing & Connecting People in Foreclosure

I need to obtain my note in NH? Where do I get it?

Also, I have been fighting for three years to obtain an affordable mortgage payment. Wells Fargo is my servicer, but my notice says US National Bank a trustee for CSCB Heat 2006/3  holder of said mortgage.

Can anyone decifer that??? I am soooo confused. I am hopeful someone can help me clear this up.

I am also looking for an attorney (low cost) help with my situation. Naca is involved know trying to get a loan modification.

I am hopeful something will help....

i found appraisal fraud.  t

back in 2005 to get woek an appraiser had to come in at selling price even if it was exagerated.

what he did not to get in trouble but to continue working.  was write out the fraud.  he was right no one in the wells fargo family read the appraisal for accuracy  all that mattered was the top line the selling  price.  imagine a small county of 170k people thats less hten some cities.  one of the ocmps has a straw buyer increasing a sale by 20k.  now that is not an isolated incident because the other comps already had prices way above the selling price  so the fraud on the other house were already comitted.  how does value incread 10% a month  what a ponzi scheme.   where does this end  why are we responsible

hi all i think we are the victims so we need to keep our heads up.  thank you jill,  learning from each othe ris going to be the key.  i do have a lawyer and am also on line everyday trying to learn and waiting for the big break. sorry but i am a very responsible person when it comes to bills  so something must be wrong if all of us cant afford our mortgages.  i have appraisal fraud.  the appraiser actuall wrote out that one of the comps had a straw buyer sale.  who in their right mind would want to buy a house and say they want to buy it for 20k more????   gee wish the lights would have went on this mess could have been prevented. i am on fannie maes web site not mers.

i live in hernando ocunty florida   the last record witht he county is wells fargo back when i closed on the loan in 2006.  of course i tried calling county to find out the legality of this since wells fargo is only my servicer and does not own my note or mortgage.  can not find ant info out.  i guess its better to keep us "dumbed" then to give us info.  there is a poster on the web site called " I Vent"  he states that our loans are already paid for.  the servicers and their lawyers are debt collectors.  at these foreclosures are illegal because  no one owns the notes.

waiting to here more on this subject.

Jill, I might be able to help - or at least point you in the right direction - but would need a lot more information.

For starters, did the closing on your mortgage occur after March 1, 2006? Also, did the Notice identify the Trustee as "US National Bank" [if so, contact your district attorney], or "U.S. Bank National Association"? When is the sale date scheduled? What loan documents, if any, do they include with the Notice in your state?

You can find the Trust's governing instrument at http://www.sec.gov/Archives/edgar/data/1352165/000116231806000477/m.... I have the schedule of individual mortgage loan account numbers and associated information for each mortgage included in this Trust. Are the first three digits of yours 406 or 407 (or "000406", etc.?) They may not be - I'm not sure if US BANK NA codes their loans or not for their investors. It includes all of the HAMP modifications that have been approved for the Wells Fargo loans in the Trust - which doesn't appear promising, but it is possible, some have been modified.

This is one toxic batch of loans.

None of this information is important if you don't have an attorney, and the non-judicial process doesn't make any sense to me. Oh, and I'm not an attorney, either. But Legal Aid Service is a great organization for this area of the law - please contact them ASAP.

Thanks for the information. We refianced in Dec 2005 with Wells, just recently I found out they re-assigned the mortgage to US National Bank Assoc for CSFB Heat 2006-3 which is the trustee. It was done in May 2010, we were never notified of any of this. We have contacted Legal Aid for advice on how to proceed. We just get foreclosure notice every 30 to 60 days by the lawyers, then we send paperwork etc, etc ( over 30 times) they postpone it, we are also working with NACA, we were in a HAMP did the trail payments then they said no. (we had a glitch in our system). Needless to say I have heard it all and seen it all when it comes to dealing with these idiots.   I also, just discovered my original mort note has a robo-signature.

I will keep on fighting...........I do not know the first digits, I have never been informed by US National Bank of anything at all. It just says they own it on the foreclosure notice

if you are in fort lauderdale, florida i may have a few suggestions

No in NH

I am also in NH. I have been looking for others in this state. You may email me at citizensagainst4closeandevict@yahoo.com . I am not an attorney but may have some info you could find useful. I was foreclosed on already but when I went to court for the eviction the other party defaulted and it was dismissed. I had listed counterclaims and numerous defenses that would require the other party to prove that they owned the indebtedness and to produce the note. My guess is that they couldn't. I hope that you were able to read this.

Best of Luck,

CAFE

send me your loan information and I will let you know if CSCB is the holder of your note.

I will let you know if this is correct - joe3of12@yahoo.com
