The bank stopped taking payments from us.Missapplied payments,triple fees,FHA fixed rate loan,payments went up they said due to taxes and insurance but they didn't,sent info over they fixed payments but the extra money for 1year and half gone.Payments change every year to more even if taxes and insurance didn't go up.They wouldn't apply payments correctly,took out of bank but didn't apply 4 to 5 weeks later on purpose.Never shown on statement monthly never shown behind at all but then all of a sudden bam hit with over 5000.00 worth of late fees.Let payments sit in applied bucket never applied our payments.They found them and was suppose to correct it but NEVER DID!!Someone any advice??They will not give attorney information of what she asked for been waiting since Feb.2008.I need help!

If you can afford an attorney I know of 2 in Ohio that I consider to be very aware.

My opinion is 1) no matter how well you present your case if you're a pro se the courts will not take you seriously 2) having represented myself pro se for 2 years now (and having the above problem in spades) I have a very good idea of what a good foreclosure attorney is. The 2 I know of are very, very competent.

Yet, I believe the game was...You make sure you pay on time...THEY hold the payments so the insurance trigger is pulled...45 days as i know it...Bam...THEY get paid and you think you are current...not your fault.

I think you should start by asking the company servicing your loan, in writing, for a full accounting of the loan, the receipt of each payment and the application of each payment to the loan.

You should also ask them, in writing, for a full accounting of the escrow account. Each amount paid into the account by you, each amount they paid out for things like taxes. Then check that amount paid out with the property tax assessor, for each and every year.

Every payment for the life of the loan and every payment into and out of the escrow account.

I would also ask them for documentation showing who owns your loan.

I would also start researching and seeking out attorneys in your county or state who specialize in Foreclosure Defense, and who do it well.
