Permalink Reply by mary on July 18, 2012 at 10:07pm HI Disabled Dad, I have not looked at your docs yet but wanted to share with you and others what I found at my recorders office on my mtg:
there is a NOD 3/2011 but then there is a 1/4/2012 notice of recission of the NOD and Then a Corrective Assignment of the DOT FOUR YEARS after the first assignment of the DOT; so, then I get a Notice of Trustee sale 3/19/2012 BUT THERE IS NO NEW NOD so, THIS is something to look for; check ALL Assignments, Corrective Assignments, NOD dates and Notice of Trustee. The bank is US BANK NA If you have not been to your recorder's office SINCE the Trustee sale go quick and get copies of everything you dont have that is new; i was surprised to find this Corrective Assignment and the Recission of the NOD then I realized there was a PROBLEM and that i may be able to whip them still!

I gotta agree with ya. I pasted the sigs together in the attached doc. I also added the supposed signature of Jeffrey Cowan who was a VP of Countrywide but wasn't in 2010 when he supposedly signed my Sub of Trustee BUT doesn't look a whole lot like the signature of Tim Bargenquast VP of QLS ?
Permalink Reply by DisabledDad on July 18, 2012 at 5:02am This is the Trustee's Deed Upon Sale . I am again requesting help to see if this is correct. With all of the Attorney in- fact and Authorized Agent stuff, it looks sleezy. How can Tim Bargenquast be an authorized Agent for McCarthy Holthus and sign the Trustee's Deed Certificate to give my house to FREDDIE MAC and also sign the Assignment of DOT(executed after sale) as VP Quality Loan as Attorney in Fact and in it grants assigns transfers to FREDDIE MAC. It appears to be overkill unless it is covering up something.

Look for dates, signatures, discrepancies, i.e., name of trusts; they listed two different names of the trusts in my docs which led to them having to do a new SOT and new NOD which they did not do.
Permalink Reply by DisabledDad on July 19, 2012 at 5:50pm Mary,There are all kinds of problems with my NOD; it doesn't contain a statement of the nature of the default, the obligation that the default is claiming defaulted isn't mine; the supposed authorized trustee that filed the NOD wasn't the authorized trustee and wouldn't be for 3 months.
That along with everything else I had (payments changed, loan terms changed and more) and yesterday the judge at my Ex Parte TRO didn't allow me to speak. He let the Freddie Mac attorney schpeel and said to me "you stopped making your payments, what do you want from me"
Funny you should mention "trusts". In every service change from BANA to/from BAC it shows FHLMC LBAC133 as the creditor yet the NOD claims BANA as beneficiary at what point does Freddie have to show itself? As the docs I posted made after the sale, are the only docs that implicate Freddie in my loan.

You wouldn't happen to know how effective a Limited Power of Attorney for QLS to act for BANA would be if it was originally recorded in Orange County and then at a later date was faxed to another county for recording, would you or anybody?
Oh and by the way it specifies what documents it can handle, NOD isn't one of them.

Permalink Reply by DisabledDad on July 24, 2012 at 8:15pm The original Limited POA was filed in Orange County on Aug 27, 2010 and it shows it was executed on Aug 18, 2010. But they just put on a new cover page and recorded it again in Solano Co. on Sept 3, 2010. My NOD was dated Aug 23, 2010.
Something I just discovered though, Brandon Sciumbato signs as SVP of BANA but the only info that can be found is SVP of CW through 2008 and Director of PennyMac currently. Also the notary , Jennifer Gordon is now the Vendor Manager at PennyMac
