How long ago did started your lawsuit? Also who is your lender and how many mnths r u behind?

April 2011, Suit against Suntrust, servicer, Wells Fargo, US Bank, MERS, Recontrust.

 

It is Case No.CV-11-2899-EMC US District Court Northern District, 9th Circuit.

 

36 Months.  We doing well.

Just be careful and avoid BK attnys unless you are trying to file one; they will push you to do one usually.Ask for current references and do not pay retainer fees without consulting with another attny as to how you should word the contract; they will use the retainer and do nothing and you will not have any recourse. if you can find an attny who will do the paper work and go in pro per.

Anyone ever hear of the U.S. Foreclosure Defense Law Group?  They are in many states to include California....

There are lots of issues re bankruptcy that come up later if you are considering litigation against your lender.  Also the bank can file a motion immediately to lift the stay which stops them from foreclosing on your home...if that's why you're filing bankruptcy.  That motion is almost always granted. 

If you're filing bankruptcy to stop a foreclosure then make your situation very clear with your attorney.  All attorneys are not bad and they understand the procedures much better than you do.  I read about more cases thrown out by judges purely because the pro per plaintiff....simply didn't follow proper procedure.

Fighting a legal battle is not an easy road.  If you choose to do it then make sure you are prepared to do it properly with experts.

I will cut my own hair but I won't remove my own appendix.

Hi D Tram,
How long ago was ur lawsuit filed n when did u stop making ur payments and whose ur lender? I am doing my due diligence n trying to gather as much info as possible b4 I decide on an attrny

I filed in April this year.  I have not made payments for three years.  God knows who my lender is.  The suit is against the Servicer, Suntrust, Wells Fargo, US Bank, MERS, Recontrust.  We have ten causes of action.  I have listed the case number above.  Just got off the phone with my attorney who called to update me on new case law at 9pm....  There aren't too many who are working on our side.  We are in front of Judge Chen in 9th district.  He is awesome.
