Anyone out there that has or is having problems with the "new" BankUnited, especially about loan modifications. We were given a loan mod in April of 2009 just before the predecessor bank (BankUnited FSB) was taken over by the FDIC and sold (and renamed! BankUnited). In the process, the new bank decided, without cause, to terminate the loan mod, without due notice, and continued to charge us the higher inte4rest. We've been fighting them for 14 months and keeping them at bay even though they have tried to foreclose. Have you had any similar experience or do you know anyone that has? If your loan was with BankUnited FSB, the current "BankUnited" may not have your loan. FDIC kept some loans. Send them a QWR. The new BankUnited is not even registered to do business in Florida. I could not find them in Sunbiz.org. It is another fraud.
Thanks Marcus. The loan was with BankUnitedFSB. The mod was approved and supposed to post in late April of 2009. But the bank was taken over by the FDIC and sold to investors who renamed the bank BankUnited (deceptive?). The new officers arbitrarily canceled the loan mod so rather than making a lower payment starting May 1, they ignored everything and kept charging the higher rate. We are trying to find out if there is anyone else that had this problem.

The use of the name "BankUnited" is a deceptive tactic on their part. You may want to do a quiet title against BankUnited FSB.

Thanks for the suggestion. I have also thought it was a bit deceptive though I do not know what the legal implications may be. Just know the new investors are brutal and bloodthirsty compared to the old FSB people.

THEY FILED UNDER "FSB" AND LATER FILED TO AMEND PARTY PLAINTIFF. THEY GOT IT AS AN EX PARTE MOTION. CHECK ON LINE DOCKETING IN PALM BEACH COUNTY.

Any update on BankUnited here in south Florida???
It seems like the new BankUnited is double dipping the asset of the old BankUnited.
BankUnited FSB went to bankruptcy in 2009. It is most likely that many mortgages were not declared in the bk filings. So now you have the new entity who is claiming to own the mortgage with no proof of anything.
One defense is to ask the new BankUnited how they acquired the loan and if it was declared as asset of BankUnited FSB in bk.
If the loan was not declared as an asset of the old BankUnited FSB, then the new BankUnited has no leg to stand on. They are just debt collectors trying to collect on an insecure debt.

this happened to me--BankUnited tried to substitute party plaintiff --luckily had a judge who said they could't do it without an affidavit, so I'm waiting to see their next move--

In my case they hired a new law firm (kahane & associates) as their counsel. New law firm filed for SJ.
