I just got a notice in the mail from Bank of America stating that the servicing of home loans by their subsidiary BAC Home loans Servicing, LP are being transferred to Bank of America, N.A. 

 

What should I do? Should I respond in any way?  I am behind on my mortgage and tried many times to get help to no avail. If anyone could help, I'd greatly appreciate it.

Who was the orginator of your loan?  Freddie is as corrupt as the rest of them.  The deeds of trust have been transfered a lot to mucky up the water.  Get a forensic audit of the PSAm, title report to prove  broken title.  Most of the loans were all securitized.  And a forensic audit of the mortgage documents for Tila violations and more violations.  Make sure it is done by some one you can trust and not for thousands of dollars.  Neil Garfields LuminiaQ group does it all for about tentyfour hundred I think,   I had the first part done and am applying for the last part the audit of the loan.   All these banks are quiltiy of fraud and crime.
My originator was a small, local mortgage company who assigned it to Wells Fargo; but immediately stamped my Promissory Note as cancelled in 8/2006.   Then the seperate sheet of paper called an Allonge, assigning note to HSBC then to Countrywide (undated).    Now BOA is telling me they are not my creditor, that Fannie Mae is; after they attempted to foreclose as the creditor/holder.   If I had not shown up at the hearing, my home would have been gone.    Since I did show up, their foreclosure mill immediately asked for the hearing to be continued.
Did they send a letter stating they were reassiging?   If they did you need to send an objection to the assignment stating you object to their authority to reassign.  An allonge is proof of fraud unless the note has so many signatures there is no room for anymore.  As long as the note has room it is like a check, the signatures first , then second , then third , then forth partie to the note is passed to until there is no room on the check.  An allonge should be glued to the note that has no more room for signatures.  THat is almost impossible.  It is a sign if fraud.  If the note is canceled then there is no note to put with the deed of trust.  They must have lost the note and are trying to fake it that the allonge is inplace of the note.  Can not be. Bank of America is trying to transfer their dirty laudry to clean up their books so investors and stock owners see a healthir bank.  No one in their right mind should trust them anymore.  Bank of America has been found to use an entitiy that is a branch of their bank and is solely owned by Bank of America.   RECONTRUST.  oUR ATTORNEY GENERAL JUST FILED A LAW SUIT AGAINST RECONTRUST, TO BAN THEM FROM THE STATE OF WA FOREVER, and claims they have foreclosed on all mortgages fraudulently, and are asking for the homes to be given back to the homeowner.   Do you see RECONTRUST anywhere on the foreclosure notices and false assignments?  They can not just cancel the note and make an allonge.  My sons home is countrywide and MERS and REFCONTRUST. If you recieve a letter from a debt collector stating Bank of America and they claim they are assigning your mortgage official from a date. And you do not object stating they are not the lender and have no authority to reassign, it is like you are a non moving party and agree they have the right.  It establishes they have the right.  Send an objection letter and a letter of dispute of the debt afforded by the FDCPA.  Remember I am not an attorney and I am just telling you what I have learned and I could be wrong.  Here are some articles for you to read.  
    

Our attorney general has claimed in the complaint that RECONTRUST has illegally foreclosed not being licensed in the state.  They were not and are not licensed in in any state. and not registered and do not have a office where the borrower can go in person to try to save their home before foreclosure happens.  The forecloser has to be an entity not related to the party they are foreclosing for. RECONTRUST IS SOLELY OWNED BY BNAK OF AMERICA.  The FDIC did not transfer the PSA's tfrom WAMU/LONG BEACH to  CHase nor Countrywide to Bank of America.  The PSA's (Pooling , securities Agreement) states it has to be transfered within 180 days or it is void.  Voids the contract.  All the homes are being stolen by false pretense.  It is crazy.  See

allonges can be proven to be fake assignments, because they are not necessary and are phoney unless there is no room to sign on the original note.   the note is like a check.  As long as there is room  for a signature the signature goes on the check[note] and not on an allonge, attached to the note.  Most likely it is a copy of the note and not the original wet ink stamped copy.  A note is like a check. A bank would laugh you out of the lobby if you come in with a copy of a check, just like a copy of a dollar bill (that would get yoy directly to jail) the bank would not cash it because it is a copy.  Someone can come in with the real check and the bank would have to honor it [and or note] it is a fake. It has to be the!!!!!!!!!!!!!note[check] not a copy with a false allonge attached.  A wet inked note with no room to sign second, third, forth, fith party on it or on and on.   There is a lot of room on a check before an allonge is needed. I would assume you can prove the allonge is false fake and fraud also.  If you take it to a professional auditor or forensic specialist.

Chances are that Bank of America does not own your note, and they are scamming you, get an audit

I would definitely get someone to determine whether the bank has a right to your house and payment. I got a free mortgage audit from www.inspectoraudit.com These guys are awesome! I have not found anyone that will get this information for FREE to you, it helped me stop a foreclosure a few days before the sale. I am not usually a person to recommend someone, but I think in this case these people helped me and may help someone else who is in trouble when the bank is trying to steal their house. When I got my mortgage audit back, I was STUNNED to find out that my Note had been sold into some kind of investment pool, and the bank did not have the right to continue to collect on me, much less foreclose on me. From what I understand that selling the notes into these pools is very complicated and I don't really understand it completely, except that the Note is no longer a Note, the bank cant claim it anymore as a Note, and  the bank has already been paid for your mortage!. They try and steal your house after they have been paid for it!! I was upset when the bank started the foreclosure on me, now I am really upset for a different reason, because they are committing fraud on me.

MY FORECLOSURE HAS BEEN STOPPED DEAD IN ITS TRACKS!! The bank was committing fraud on me and trying to take my house and they cant now, I have a lawyer that is using the the audit I got from inspectoraudit.com and he is turning the tables on the bank. I love it and I feel so empowered now! Being on the offensive is much better than being on the defensive. Good Luck with everything
