Hello everybody--please tell me if you have copies of allonges from IndyMac Bank or OneWest--I am looking for patterns of fraud here.

Are you in bankruptcy? Do you have an attorney? I have a good one. Whose names are on the allonges? Are the allonges from IndyMac or from OneWest? What dates, if any, are on the allonges? Can you email or fax me a copy?
Permalink Reply by SD Foreclosure fighter on March 4, 2013 at 1:47pm I am in Civil court right now. I had to let my attorney go as he wouldn't use any of the evidence I gave him, including 29 Assignments signed by the same person who signed mine, all with different signatures.
The allonges are from Dollar Mortgage Corp to IndyMac Bank and then IndyMac Bank in blank. In SD noone wants to fight against the lenders as I get the impression that would be bad for business as most of them represent the banks on a normal business even though they don't represent my lender, it could change the face of foreclsoures in SD. I would gladly send you a copy. The 2 notes were filed in 2 separate case filings so they came into possession of the note after the 1st one but want the court to believe they had it all along. What state are you in.
Right now I am working on my response to OneWest's request for Summary Judgment as they have not complied with the Court's order to produce documents surrounding the note and assignment of the mortgage. They don't even know I have all this evidence because as I stated my attorney wouldn't use it. If you send me a reminder reply I will send that tomorrow. I just have to finish this today.
Permalink Reply by myles aldlridge on March 4, 2013 at 2:04pm I wish you were in bk, in Judge Laura Taylor's court in San Diego. She warned owb about those fake allonges. Google "Arizmendi, Judge Taylor, Brian Burnett" and you'll get the anti-foreclosure fraud sites that contain the court proceedings where she chewed them out and warned them.
I think bk is the only court that gives a squat about consumers. But maybe you can get a lead on decent lawyers from Googling the "Livinglies weblog" site. The "stopforeclosurefraud.com" site also has attorneys advertizing there.

Hmmm...maybe I can indirectly bushwack them in my case, creating a ruling that can be used by you and others in your own cases!

Permalink Reply by SD Foreclosure fighter on March 4, 2013 at 2:34pm They even sent me a pay history after they received payment from the MI company showing my account paid then added a new balance 5 months later. I hope the Judge sees my point of view. He warned OWB that he was concerned about some of the documents they provided. I hope when I slap them with this, they will go away but at least it gives me more time to get ready for BK.
